JUDGMENT

[JUDGMENT OF THE COURT WAS DELIVERED BY C.T.SELVAM, J] The Civil Miscellaneous Appeal has been preferred against the decree and judgement dated 20.03.2013 made in H.M.O.P.No.2608 of 2004 passed by the learned Principal Judge, Family Court at Chennai.

2. On 13.11.2017, this Court passed the following order: "The Civil Miscellaneous Appeal has been preferred against the decree and judgement dated 20.03.2013 made in H.M.O.P.No.2608 of 2004 passed by the learned Principal Judge, Family Court at Chennai.

2. Today, both the parties are present. Learned counsel for appellant submitted that Joint Memo of Compromise dated 09.11.2017 has been filed informing compromise between the appellant and respondent.

3. In view of the Joint Memo of Compromise entered into between the parties, the Civil Miscellaneous Appeals shall stand closed. Memo of Compromise shall form part of the records. No costs.

4. Post on 14.12.2017 for "Reporting Compliance".

Today the matter is listed 'for reporting compliance'.

3. Parties on either side as also respective counsel are present. Joint memo of compromise signed by the respective parties as also their counsel informing settlement of the dispute between the parties has been filed. Return of articles by either side is also informed. A sum of Rs.23,00,000/- has been paid today by way of demand draft Nos.367025, 367534 and 367354 drawn on Indian Overseas Bank, Periyar Nagar Branch, Chennai, by the appellant to the wife and child. In keeping with the settlement arrived at, the order of the learned Principal Judge, Family Court, Chennai dated 20.03.2013 passed in H.M.O.P.No.2608 of 2004 shall stand set aside and the Civil Miscellaneous Appeal shall stand allowed with the effect that there shall be a decree of divorce by mutual consent by dissolving the marriage held between appellant/husband and respondent/wife dated 04.06.2003. Joint memorandum of compromise filed by the parties shall form part of the records.
