ORDER

The petitioners apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 303(2), 326(a) of BNS Act r/w Sections 21(5) of Mines and Minerals (Development & Regulation) Act, in Crime No. 07 of 2026, seeks anticipatory bail.

2. The case of the prosecution is that based on secret information, the respondent police went to the scene of occurrence and found that the petitioners had illegally quarried one unit of river sand with the help of tipper lorry. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that the petitioners have not committed any such offence as alleged by the prosecution and they have been falsely implicated in this case. Hence, he prayed to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioners have five previous cases pending against them. Hence, he opposed to grant anticipatory bail to the petitioners.

5. Considering the nature of allegations, the petitioners have five previous cases pending against them and also considering the fact that

the petitioners are not only illegally quarried river sand but also caused damage to the ecology and river bed, this Court is not inclined to grant anticipatory bail to the petitioners.
