PRAYER :

Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to pay compensation of Rs.5,00,000 to the petitioners for the death of her husband V.Sasidharan caused by the negligence of the respondents on 20.08.2007 at Broad way and St.Xavier Road Junction, Chennai - 600108.

ORDER

This writ petition has been filed seeking a direction to the respondents to pay compensation to the petitioners for the death of one V.Sasidharan, who succumbed to death on 20.08.2007, due to electrocution.

2. According to the petitioners, they, being the legal heirs of the deceased V.Sasidharan, submitted a representation to the respondents seeking compensation, alleging that the deceased died due to the negligent act on the part of the respondents. However, the said representation has not been considered by the respondents, till date. Hence, this writ petition.

3. When the matter was taken up for hearing, the learned counsel for the petitioners, fairly submitted that due to efflux of time, the petitioners may be granted liberty to approach the respondents with a fresh representation for the relief sought for herein, for which, the learned counsel appearing for the respondents has no serious objections.

4. Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court disposes of this writ petition, granting liberty to the petitioners to file a fresh representation before the respondents along with a copy of this order, within a period of two weeks from the date of receipt of a copy of this order. On such filing, the respondents shall consider the same and pass appropriate orders, on merits and in accordance with law, after affording due opportunity of personal hearing to the petitioners within a period of six weeks thereafter. No costs.
