This Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent to consider the petitioner to appoint on the basis of apprentice training without subjected to any further test or selection process in the light of the order passed by the Division Bench Judgment dated 20.09.1995 in W.A.No.375, etc of 1995 and grant such other relief as deems fit to this Honourable Court under the circumstances of case. O R D E R

The relief sought for in the present writ petition is for a direction to direct the respondent to consider the petitioner to appoint on the basis of apprentice training without subjected to any further test or selection process in the light of the order passed by the Division Bench Judgement dated 20.09.1995 in W.A.No.375, etc of 1995.

2. The relief sought for in the present writ petition is absolutely misconceived. The order passed by the Honourable Division Bench on 20.09.1995 may not have any application, in view of the fact that the entire procedures and the method of recruitment had underwent many changes. This apart, the appointments were granted based on the Apprenticeship training long back and the procedure was said to be irregular and now, the respondents are selecting and appointing candidates only by following the Recruitment rules in force and through open https://hcservices.ecourts.gov.in/hcservices/

competent process. Thus, the writ petitioner cannot seek an appointment on the basis of the apprenticeship training undergone by him.

3. All appointments are to be made strictly in accordance with the recruitment rules in force. Equal opportunity in Public employment is the constitutional mandate. All eligible employees, who all are aspiring to secure Public Employment must be provided with an opportunity to participate in the open competitive process. This apart, the completion of Apprenticeship training will not confer any right on the candidate to seek appointment without undergoing the process of selection and the tests, which all are to be conducted during the process of selection.

4. This being the procedures to be adopted, this Court is of an opinion that the relief as such sought for in the present writ petition cannot be considered at all.
