This application has been filed to condone the delay of 167 days in filing the Written Statement in the above suit by the Defendant.

2. I heard the learned counsel for the applicant/defendant and the learned counsel for the respondent/plaintiff.

3. The learned counsel for the applicant submitted that the matter was referred for mediation and therefore, the written statement could not be filed in time. Therefore, he submits that the delay is liable to be condoned.

4. The learned counsel for the respondent/plaintiff has no objection if this application is allowed.

5. Upon consideration of the aforesaid submissions and on examining the affidavit in support of the application, I find that the applicant has made out sufficient cause to condone the delay. Accordingly, the application is allowed and the delay of 167 days is condoned.
