Company Application No.249 of 2018 KRISHNAN RAMASAMY, J., This Application has been filed to direct the respondents/debtor company (a) to pay the debt amount of Rs.9,29,208.88/- towards entire settlement along with subsequent interest @ 18% per annum till the date of final payment. (b) To direct the respondent/debtor to return the assets as per Clause 3 (d) of the Lease Agreement. (c)To permit the Official Liquidator, the cost of this Application does come out of the funds of the Company in Provisional Liquidation.

2. The learned Official Liquidator submitted that since the present case pertains to recovery of money from the 1st Respondent, they are supposed to obtain permission from the Central Government in terms of Section 86 of the Civil Procedure Code, before filing this Application and as they did not obtained prior permission from the Central Government, she seeks 1/3

KRISHNAN RAMASAMY, J., arr permission of this Court to close this Application, with liberty to file the same, after obtaining necessary permission from the Central Government.

3. In view of the submission made by learned Official Liquidator, this Application stands closed with liberty to the learned Official Liquidator to file fresh Application after getting required permission from the Central Government, as per Section 86 of the Civil Procedure Code.
