Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records of the 2nd respondent herein in RC No.2856/2015 PA1 dated 31.03.2015, quash the same and direct the 2nd respondent herein to permit the petitioner to retire from service.

The charge memo issued to the writ petitioner in proceedings dated 31.03.2015 is under challenge in the present writ petition. 2.The learned counsel for the writ petitioner made a submission that the enquiry proceedings had already been completed and the enquiry officer submitted his report. Based on the final enquiry report, further explanation is called for from the writ petitioner by the competent authority. 3.Under these circumstances, the writ petitioner is at liberty to submit his further explanations based on the enquiry report to the disciplinary authority/competent authority and on receipt of the explanation, the competent authority is at liberty to pass final orders in the disciplinary proceedings without causing any undue delay.

4.With these observations, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
