ORDER
The petitioner has filed this petition seeking a direction to dispose of HMOP.No.324 of 2015 pending on the file of the Subordinate Judge, Poonamallee, within the time frame fixed by this Court.
2. The petitioner-husband filed HMOP.No.324 of 2015 on the file of Sub Court, Poonamallee, for divorce on the ground of cruelty. The marriage between the petitoner and respondent was
solemnised on 12.02.2014 at Arulmigu Mariamman Thirukoil, Punniyanallur Village, Mariamman Koil Post, Tanjore Taluk and District, as per Hindu Rites and Customs. Due to the family dispute that arose between them, the petitioner and respondent are living separately. Thereafter, petitioner-husband filed a petition under Section 13(1) (i-a) and (iii) of the Hindu Marriage and Divorce Act 1955, praying for dissolution of marriage. The respondent-wife filed counter statement on 08.11.2016. The petitioner-husband filed proof affidavit on 07.03.2017. From that date onwards, the said HMOP is pending before the trial Court. Under the said circumstances, the petitioner has come out with the present Civil Revision Petition, seeking a direction to the learned Sub Judge, Poonamalle, to expedite the disposal of the petition in HMOP.No.324 of 2015, within a time frame to be fixed by this Court.
3. Heard the learned counsel appearing for the petitioner.
4. Having regard to the submissions made by the learned counsel for the petitioner, and considering the limited prayer sought for in the civil revision petition, this Court directs the Subordinate Judge, Poonamallee, to dispose of the petition in HMOP.No.324 of 2015, on merits and in accordance with law, as
expeditiously as possible, in any event, not later than 31st August 2017.
5. The Civil Revision Petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
