PRAYER : Petition under Article 226 of the Constitution of India praying for issuance of Writ of Certiorari, calling for the records of the 2nd respondent made in his proceedings Rc.No.1581/A2/2004 dated 04.08.2004 and quash the proceedings of the 2nd respondent dated 04.08.2004.

ORDER
Heard Mr.B. Manoharan, learned counsel representing Mr.M.Muthugeethayan, learned counsel for the petitioner, Mr.A. Rajaperumal, learned Additional Government Pleader for the respondents 1 and 2 and Mr.V. Ajoy Khose, learned counsel for the respondents 3 to 6.
2. With the consent of learned counsel on either side, this writ petition itself is taken up for final disposal.

This writ petition has been filed challenging an order passed by the 2nd respondent, directing the petitioner institution to revoke the order of suspension and pay all consequential benefits on account of the fact that the petitioner Management were unsuccessful in their time to challenge the orders passed by the authorities refusing to extend the period of suspension beyond a period of two months in W.P.No14797 of 2004 dated 14.07.2004.
4. The present writ petition has not been maintainable and the petitioner institution cannot commence a second round of litigation and they are bound to implement the impugned order. If the impugned order has not been implemented and the period of suspension has already been over, the same shall not be done by the respondent Management and a proposal shall be submitted by the petitioner within a period of six (6) weeks from the date of receipt of a copy of this order.
