PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records of the 2nd respondent relating to the Notice bearing L.R.No.X/CFC/G1/DFC/AO/R/E.7/C.No.611 dated 03.07 2004 directing the petitioner to pay the audit amount of Rs. 10,184/- which was confirmed in the demand made by the 3rd respondent in his notice No.AE\OC\KKS\KS\F Audit\D.No.115 dated 23.07.2004 and quash the Notice dated 03.07.2004 and direct the respondents 1 to 3 to restrain from disconnecting the supply of electrical energy to the holiday home owned by the petitioner.

The learned counsel for the writ petitioner made a submission that the writ petition is filed challenging the demand notice dated 23.07.2004, directing the writ petitioner to pay a sum of Rs. 10,000/-.

2. The learned counsel for the writ petitioner submits that the petitioner is ready and willing to clear the demanded amount and the same would be paid without any further delay. In view of the undertaking, the petitioner is directed to pay the arrears of Current Consumption Charges as demanded by the respondent Board within a period of two weeks from the date of receipt of a copy of the order. On receipt of the arrears of Current Consumption Charges, no further action is needed and in the event of failure on the part of the writ petitioner, then the respondents are at liberty to initiate all further actions in accordance with the regulations.

3.With these directions, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
