Respondent(s) This petition is filed under Article 226 of Constitution of India to issue a writ of Mandamus directing the respondents herein to consider and pass orders refunding the electricity tax on the maximum demand charges collected from the petitioner from February 1998 to June 2003 in accordance with law and pass orders in terms of the petitioners application dt 16.9.2008 and 1.10.2008.

ORDER

The petitioner has made a representation to the respondents herein to consider and pass orders refunding the electricity tax on the maximum demand charges collected from the petitioner from February 1998 to June 2003 in accordance with law and pass orders in terms of the petitioners application dt 16.9.2008 and 1.10.2008 and the same is not considered. Hence, the present writ petition.

2. The learned counsel for the petitioner submitted that this Court may issue a direction to the first respondent to consider the petitioner's representation and pass appropriate orders within the stipulated time as fixed by this Court.

3. The learned Standing Counsel submitted that this Court may direct the petitioner to make a fresh representation to the respondents.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the facts and circumstances of the case and having regard the submissions made by the learned counsel on either side, this Court directs the petitioner to make a fresh representation to the first respondent along with all the relevant documents within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of the same, the first respondent shall consider the same and pass orders on merits and in accordance with law, within a period of twelve weeks, thereafter, if not already disposed.
