This writ petition has been filed for the issue of a writ of mandamus directing the 2nd and 3rd respondents to issue a new electricity service connection to the petitioner in order to enable the petitioner to conduct business in the subject property.
2.The petitioner is the tenant in the subject property and the 4th respondent is the landlord. There seems to be some dispute between the petitioner and the 4th respondent and as a result of the same, the electricity service connection was disconnected. The petitioner made an application/representation before the respondents, seeking for a fresh electricity connection to enable the petitioner to conduct the business. Since the same was not considered, the present writ petition has been filed before this court seeking for appropriate directions. 3.When the matter was taken up for hearing, the learned Standing Counsel appearing on behalf of the respondents 1 to 3 submitted that the representation made by the petitioner was kept pending since there was a civil litigation that was pending before the District Munsif Court, Vellore.
The learned Standing Counsel further submitted that since the case has gone in favour of the 4th respondent, the 2nd respondent will take a decision on the representation/application given by the petitioner and inform the petitioner within a period of one week from the date of receipt of copy of this order. 4.Taking into consideration the facts and circumstances of the case and submissions made by the learned Standing Counsel, there shall be a direction to the 2nd respondent to act upon the representation/application made by the petitioner seeking for separate service connection and convey the decision to the petitioner within a period of one week from the date of receipt of copy of this order.
5.This writ petition is disposed of with the above directions. No costs. Consequently, connected miscellaneous petition is closed.
