PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling the Board Proceedings of the 2nd Respondent in (PER) B.P.No.18 dated 29.12.2001 and quash the same and direct the respondent to levy the Additional Current Consumption Deposit only on the basis of 45 days on par with H.T. Service Connection.

The relief sought for in the present writ petition is to quash the Board Proceedings of the 2nd Respondent in (PER) B.P.No.18 dated 29.12.2001 and further to direct the respondent to levy the Additional Current Consumption Deposit only on the basis of 45 days on par with H.T. Service Connection.

2. The learned counsel for the respondent brought to the notice of this Court that, in respect of the levy of Additional Current Consumption Deposit, it varies every year based on the usage of electricity by the consumers. In view of the efflux of time and more specifically, now, after a lapse of 14 years, there may be a variation of the deposit amount to be paid by the writ petitioner.

3. Under these circumstances, the cause aroused initially for the purpose of filing this writ petition deserves no further adjudication and Accordingly, the present writ petition stands closed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
