W.P.No.2761 of 2023 M.SUNDAR, J., and M.NIRMAL KUMAR, J., [Order of the Court was made by M.SUNDAR.J.,] Captioned matter was disposed of by us by an order dated 10.02.2023 inter alia granting 10 days leave with escort (strength of escort at the discretion of the State). We also directed the captioned matter to be listed under the cause list caption 'FOR REPORTING COMPLIANCE'.

2. Today, Dr.S.Manoharan, learned counsel for petitioner and Mr.R.Muniyapparaj, learned Additional Public Prosecutor for respondents submit in one voice that the detenu did not avail of the leave as he did not want to go with escort.

3. Learned counsel for petitioner submits that earlier he was given leave without escort and if he accepts this now, he may be in difficulty in future.

4. However, our order is clear that leave should be granted with escort and strength of escort is at the discretion of the State. State has granted leave with escort. Therefore, the order has been complied with, compliance is recorded.
