ORDER

The petitioner, who was arrested and remanded to judicial custody on 30.12.2025 for the alleged offence punishable under Section 123 of BNSS, in Crime No.782 of 2025, registered on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that he joined hands with other accused was found to be in illegal possession of 498 number of Tapentadol tablets. Hence, the complaint was lodged and the petitioner was arrested and is in judicial custody.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case, since he has got some previous cases and that the petitioner is in judicial custody since 30.12.2025. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that the petitioner has five previous cases, similar in nature pending against him and that the property was recovered from this petitioner. Hence, he opposed to grant bail to the petitioner.

5. Considering the nature of the allegations, the fact that the petitioner has five previous cases, similar in nature pending against him, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 02.02.2026 drl 2/4
