ORDER
The captioned writ petition has been filed seeking issuance of a writ of mandamus directing the respondents to treat the service rendered by the petitioner from May 2010 to April 2012 as regular service and to grant all consequential benefits to which she is entitled.
2. Heard the learned counsel appearing on either side. The materials available on record have been duly considered.
3. The primary contention of the petitioner is that Vijayanta Model Higher Secondary School (hereinafter referred to as "VMHS School" for the sake of brevity) is affiliated to the CBSE Board and that, as per the CBSE Byelaws, the age of retirement of teachers is 60 years. However, according to the petitioner, the respondent Management has treated her age of retirement as 58 years.
4. The respondents 2 to 5 have filed a counter affidavit stating that the petitioner is not governed by the CBSE Bye-laws and Rules, since the VMHS School, in which the petitioner was working, is affiliated to the Tamil Nadu
State Government Board. As per the Bye-laws of the Society and the State Government Rules, the age of retirement of teachers working in schools affiliated to the State Board is 58 years. This contention has not been rebutted by the petitioner by producing any substantive material to establish that she was working in a CBSE-affiliated school.
5. The first respondent-CBSE has also filed a counter affidavit stating that the said school is affiliated to the State Board and not to the CBSE Board.
6. In light of the above, this Court finds that the captioned writ petition is devoid of merit and, accordingly, the same is dismissed. There shall be no order as to costs..
