Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records connected with the proceedings issued in Na.Ka.No.111557/Po.THa.1/Iru3 dated 18.03.2014 passed by the first respondent and quash the same and consequently direct the respondent to appoint and regularize the petitioners service in the post of Mazdoor available in the Malaria Eradication Scheme. This writ petition has been filed challenging the proceedings bearing Na.Ka.No.111557/Po.Tha.1/Iru3 dated 18.03.2014, whereby the first respondent rejected the claim of the petitioners for permanent absorption into service as 'Mazdoor' in Malaria Eradication Programme.
2. The respondents, while passing the impugned order, taken note of the fact that the petitioners herein were appointed purely on temporary basis under the 'Malaria Eradication Programme' and that there are no sanctioned posts for absorption of the services of the petitioner.
3. As seen from the affidavit filed in support of the writ petition as well the impugned proceedings, it is evident that the petitioners worked only for a very short period on a temporary basis and that there are no sanctioned posts.
4. In the absence of any scheme providing for absorption or regularization of the services of the temporary employees, the question of petitioners making a claim for permanent absorption does not arise. In the absence of availability of sanctioned posts, and in the absence of any selection process undergone by the petitioners, they have no right to claim permanent absorption as sought in the present writ petition.
5. In the circumstances, this court does not see any merit in the writ petition and the same is accordingly dismissed. No costs. Connected miscellaneous petitions, if any, shall sand closed. 21.07.2025 skr Index : Yes / No Speaking order / Non-speaking order
