ORDER

The petitioner, who was arrested and remanded to judicial custody on 11.12.2025, for the offences punishable under Sections 64, 75, 78(2), 318, 351(2) of BNS, 2023 and Section 66E of IT Act, 2000 in Crime No. 64 of 2025 on the file of respondent police seeks bail. 1/4

The allegation against the petitioner is that the petitioner has developed contact with the victim girl through telegram app and under the guise of helping her in preparing government exams moved with her and stalked her continuously and thereafter, he had sexual relationship with her and recorded the same without her knowledge and unable to bear the humiliation, she has come forward to lodge a complaint before the respondent police. Hence, the case has been registered and the petitioner has been arrested on 11.12.2025.

The learned counsel for the petitioner submitted that petitioner was arrested and remanded to judicial custody from 11.12.2025 and already mobile phone of the petitioner was seized by the respondent police and the major portion of the investigation is completed and now, he is ready to abide by any condition imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that though the property was recovered, it contained of some videographs of the victim girl which was recorded without her knowledge. He further submitted that 2/4

the petitioner is a habitual offender, already similar case was registered in Crime No. 23 of 2023 on the file of Theni Cyber Crime and therefore, he opposed for grant of bail to the petitioner.

5.Considering the nature of allegations, and also the petitioner is a habitual offender in similar offences; if bail is granted to the petitioner he would indulge in similar offences in future, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition shall stands dismissed.
