Petitions filed under Section 11 of the Contempt of Courts Act, 1971 to punish the respondent herein for committing Contempt of Court by disobeying the order passed by this Court dated 08.01.2010 made in W.P.Nos.1984, 1985, 1988, 1989, 1991, 1992, 1993, 1995, 1998, 1999, 2126 and 2130 of 2005.
For Petitioner : Mr.K.M.Ramesh, (In all Contempt Petitions) For Respondent : Mr.R.Balaramesh (In all Contempt Petitions) COMMON ORDER The respondent, Tmt.R.Narmadha Devi, General Manager, Salem District Co-op. Milk Producers' Union Ltd., Salem, is present pursuant to the statutory notice issued on 30.04.2021, through virtual mode. 2.The respondent made a submission that the amounts ordered as per the Court have been settled in favour of the workmen during the second week of June, 2021.
3.The learned counsel for the petitioners made a submission that the amount due to the workmen was computed in the year 2003. The writ petitions filed by the Management were dismissed on 08.01.2010 and the writ appeals filed by the Management were dismissed on 28.02.2011 and the Special Leave Petitions filed were also dismissed on 24.09.2019. Thereafter, they have issued proceedings on 15.06.2021, after issuance of
statutory notice by this Court. However, it is admitted that the amounts due to the workmen are paid. In respect of eight workmen, they have collected the amount from the office of the respondent and two workmen, it was sent through post, which was acknowledged. The learned counsel for the petitioner made a submission that respondent is liable to pay interest. However, in a contempt proceedings, subsequent interest cannot be granted, as the Hon'ble Supreme Court disposed of the Special Leave Petitions on 24.09.2019.
4.In view of the facts and circumstances, the parties to the contempt petitions have jointly stated that the amounts due to the workmen, as per the orders of the Court, have been settled and thus, no further adjudication needs to be entertained and accordingly, the contempt petitions stand closed. No costs.
