This petition is filed to condone the delay of 38 days in filing the above appeal.

2.Heard the learned counsel for the petitioner/appellant and the second respondent.

3.Being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay of 38 days in filing the appeal is condoned, subject to the waiver of interest for the delay period and the petition is accordingly, allowed.

4.The Registry is directed to number the appeal, if the papers are otherwise in order and post the matter on 26.03.2024.
