PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, forbearing the respondents or their subordinates from interfering with the petitioner's possession and enjoyment of the property viz., the vacant land measuring an extent of 37 cents (15 ares) comprised in Punjai S.No.67/6 in Pattabiramapuram Village in Tiruttani Taluk in Thiruvallur District.

This Writ Petition has been filed to issue a Writ of Mandamus, forbearing the respondents or their subordinates from interfering with the petitioner's possession and enjoyment of the property viz., the vacant land measuring an extent of 37 cents (15 ares) comprised in Punjai S.No.67/6 in Pattabiramapuram Village in Tiruttani Taluk in Thiruvallur District.

2. There is no representation for the petitioner and hence the following order is passed on merits.

3. The learned Government Advocate submitted that the subject property was encroached and the petitioner is a trespasser into the subject property owned by one Chinnammal. In fact, the acquisition officer acquired the subject property which belonged to one Chinnammal. Therefore, the petitioner is no way connected with the subject matter and he is a trespasser. That apart, the said Chinnammal, challenged the acquisition proceedings in W.P.No.6808 of 1992 and the same was dismissed by this Court on 27.10.1999. Therefore, the Writ Petition is devoid of merits and is liable to be dismissed.

4. Accordingly, the Writ Petition stands dismissed. Consequently, connected Miscellaneous Petition is closed. No cost.
