Mr.P.Thirumalaivasan, learned counsel representing the counsel on record for the sole writ petitioner, Mr.C.Selvaraj, learned State Counsel for first respondent and Ms.Madhu, learned counsel representing Mr.N.Murali, counsel on record for third respondent are before this virtual Court. To be noted, writ petition has been dismissed as against the second respondent vide order dated 21.12.2009.

2. It is not necessary to dilate on facts owing to a Memo for withdrawal (email filed by counsel for writ petitioner) and a scanned reproduction of the Memo and email under cover of which the Memo has been email filed are as follows:

3. Learned counsel reiterates the contents of aforesaid withdrawal Memo. Besides this, learned counsel expresses regret for not representing the matter in three previous listings i.e., 10.08.2021, 12.08.2021 and 13.08.2021 saying the first named counsel Mr.T.Pappaiah Dharmarajan is no more and that has caused the difficulty.

4. Be that as it may, in the light of the aforesaid Memo and reiteration of the same in the virtual hearing today, captioned writ petition is dismissed as withdrawn. There shall be no order as to costs. Consequently, connected Miscellaneous Petition being MP.No.2 of 2008 is also dismissed as withdrawn.
