C.M.P.No.1837 of 2021 in A.S.No.483 of 2008 G.JAYACHANDRAN, J.

This petition is filed to bring on record the legal representatives of the deceased sole appellant, who died on 27.04.2020 pending appeal. In support, the petitioners has annexed the death certificate of the sole appellant G.R.Sampath along with the legal heir certificate.

2. In the main appeal, notice served to the 3rd respondent. As far as the respondents 1,2,4 & 5 service awaited. The respondents 1, 2 and 4 herein remained exparte before the trial Court.

3. The learned counsel for the 6th respondent is present today and says no objection. Since the respondents 1, 2 and 4 were not interested in contesting the suit and remained exparte before the trial Court, no further notice is required to the respondents 1,2 and 4 in this petition. Hence, the Civil Miscellaneous Petition is allowed. The petitioners are impleaded as appellants 2 to 4 in the appeal.

4. The learned counsel for the appellant is permitted to take private notice to the 5th respondent in A.S.No.483 of 2008 returnable by three weeks.

5. Post the main appeal after three weeks.
