Respondent Prayer: Petition filed under Article 226 of the Constitution of India praying to issue a writ of certiorarified mandamus calling for the records of the respondent in connection with the impugned show cause notice issued in C No.D2/PR36/2002 dated 29.10.2008 and quash the same and direct the respondent to treat the period of suspension as duty for all purposes and also promote the petitioner as Head Constable at par with his junior and grant him all consequential service and monetary benefits. The writ petition has been filed challenging the impugned show cause notice issued by the respondent in C No.D2/PR36/2002 dated 29.10.2008 and seeking a direction to the respondent to treat the period of suspension as duty for all purposes and also promote the petitioner as Head Constable on par with his junior and grant him all consequential service and monetary benefits. 2.When the matter is taken up for hearing, learned counsel appearing for the petitioner fairly submitted that since the respondent has treated the period of suspension as duty period for all purposes and paid the monetary benefits to the petitioner, the prayer in the writ petition has become infructuous.
