Respondents Criminal Revision filed under Section 397 and 401 Cr.P.C. against the order of the learned Special Judge (TNPID Act), Coimbatore dated 28.01.2014 in Crl.M.P.No.1830 of 2013 in C.C.No.16 of 2013 and to set aside the same.

This revision has been preferred against the dismissal of petition for discharge by learned Special Judge, TNPID Act, Coimbatore dated 28.01.2014 in Crl.M.P.No.1830 of 2013 in
C.C.No.16 of 2013, wherein petitioners/A2 and A3 are charged of offences under sections 120B, 406, 420 of IPC and Section 4 of Tamilnadu Protection of Interest of depositors (In the Financial Establishment) Act 1997.
2. Pursuant to completion of investigation in Crime No.6 of 12 on the file of the respondent and filing of final report under section 173(2) Code of Criminal Procedure informing commission of offences under section 120(B), 406, 420 of IPC and Section 5 of the Tamilnadu Protection of Interest of depositors (In the Financial Establishment) Act 1997, case is pending trial in C.C.No.16 of 2013 on the file of learned Special Judge for Cases under TNPID Act, Coimbatore. Petitioners/A2 and A3 sought discharge in CMP.No.1830 of 2013 and such petition was dismissed by the learned Special Judge under Order dated 28.01.2014. Challenging the same, the present revision has been filed.
3. Heard learned counsel for petitioners and learned counsel for respondents.
4. Pending revision, the matter has been referred to mediation and the report of the Tamilnadu Mediation and Conciliation Centre, High Court, Madras dated 04.07.2016 informs a scheme of arrangement between the petitioners and 45 complainants/depositors. Learned counsel for petitioners submit that the claim of the other depositors had been settled even before taking of the case on file.

In the aforesaid circumstances, it is considered proper to dispose of this revision with a direction to learned Special Judge to consider the settlement agreed upon between the petitioner and 45 depositors, pendency of other claims, if any and the applicability of Section 5 of TNPID Act. The original mediation report dated 16.09.2015 shall be forwarded to court below and a copy of the same shall form part of records in this revision. Accordingly, this revision is disposed of.
