The impugned auction sale scheduled to be held on 01.09.2004 is under challenge in the present writ petition. Apparently, the date of auction has lapsed and nothing survives for adjudication. If it all, the subject property is to be auctioned, the same can be done only by a fresh auction. As such, the prayer in the Writ Petition has become infructuous. Hence, the present Writ Petition stands closed. Consequently, connected Miscellaneous petition is closed. No costs.
