(Order of the Court was made by the Hon'ble Acting Chief Justice) Learned counsel for the petitioner submits that on the subject matter, a public interest litigation is pending where all the issues raised, including the issue raised herein are pending consideration. Thus, leave may be granted with a direction to place this appeal along with the public interest litigation.
2. The leave application has been opposed on the ground that it is up to the statutory authorities to take action in the matter and for that, the Medical College has volunteered for surprise inspection. Therefore, there is no reason to maintain the appeal and to grant leave.
3. Heard learned counsel for the parties and find that the appellant seeking leave in this appeal is the petitioner in the public interest litigation on the subject matter. Thus, we find reason to accept the application to grant leave and accordingly, leave is granted.
