The Writ Petition has been filed under Article 226 of the Constitution of India, seeking writ of mandamus directing the 4th respondent to foreclose forthwith the Fixed Deposit bearing No.005400, release and disburse the entire balance lying to petitioner credit in Savings Bank Account No.5712, and pay a total Sum of Rs.1,14,071/- (Rupees One Lakh Fourteen Thousand and Seventy - One Only) Together with all accrued interest thereon till the date of actual payment.

ORDER

Heard Mr.A.Ashok Kumar, learned counsel for the petitioner and Mr.K.Tamilvendan, learned Government Advocate appearing for the respondents 3 and 4, and Mr.Meganathan, learned Government Advocate appearing for the second respondent.

2. The petitioner is a member of the fourth respondent Society. She opened a Savings Account with the said Society in Savings Account No.5712. She had been operating the account on a regular basis. On 09.03.2022, the petitioner availed a fixed deposit scheme floated by the fourth respondent, and deposited a sum of Rs.93,600/-. On that date, the petitioner states that the amount outstanding in her savings account was Rs.20,471/-.

3. The fixed deposit matured on 09.03.2023. The petitioner called upon the fourth respondent to honour the fixed deposit and make the payment. The

fourth respondent did not do so. Thereafter, she made a representation on 06.01.2026 to the respondents 2 to 4 and the District Collector, calling upon them to act in accordance with law and to refund the amount that she is rightfully entitled to. As the representation did not elicit any response, she is before this Court.

4. When the matter came up for admission, I deleted the District Collector from the array of parties as he has nothing to do with the Cooperative movement. I also pointed out Mr.K.Tamilvendan, and Mr.S.Ravikumar, who then took notice on behalf of the respondents 3 and 4, that the amounts due to the petitioner cannot be withheld indefinitely and called upon them to file an affidavit as to how long they will take to refund the amounts, which the petitioner is rightfully entitled to. They sought for time. I adjourned the matter today.

5. When I took up the matter, Mr.Tamilvendan has filed an affidavit that on account of financial constraints in the fourth respondent Society, they were not able to honour the fixed deposit. He has filed an undertaking affidavit to the effect that the fourth respondent would return the matured amount along with the balance in the savings account within one month from the date of receipt of a copy of the order. The undertaking affidavit is scanned and extracted hereunder:

6. The undertaking given in the unnumbered paragraph No.2, in page No.3 of the affidavit is recorded. In terms of the undertaking, there shall be a direction to the respondent 3 and 4 to ensure that the amount in petitioner's savings account, as well as the fixed deposit placed by her with the fourth respondent are paid within 30 days from today. Accordingly, the Writ Petition is disposed of. No costs.

7. The respondent No.4 will not wait for the certified copy of the order. He shall make payment within a period of 30 days granted by this Court, acting on the web copy of this order.
