Second Appeal filed under Section 100 C.P.C., against the judgment and decree in A.S.No.48 of 2000 on the file of the Sub Court, Thiruvannamalai dated 17.12.2004 , confirming the judgment and decree in O.S.No.233 of 1994 on the file of the District Munif, Polur dated 25.1.2000.

JUDGMENT

Learned counsel for the respondent submitted that the sole respondent died in the year 2013 itself and to that extent, he has also filed a memo furnishing all the details of the legal heirs of the sole respondent vide memo dated 3.12.2018.

2. Even today, the appellant did not take any steps to implead the legal heirs of the sole respondent. Learned counsel for the appellant also reported no instructions from the sole appellant to implead the legal heirs of the deceased sole respondent.

3. Considering the facts and circumstances of the case and submissions made by either counsel on record, this second appeal is dismissed as abated. No costs.
