This Writ Petition has been filed challenging recovery proceedings initiated by the Assessing Officer, the 2nd respondent in terms of the Income Tax Act, 1961 (Act) pending an appeal filed by the petitioner before the Commissioner of Income Tax (Appeals), arrayed as first respondent before me.

2. Mr.A.P.Srinivas, learned Senior Standing Counsel files a counter today on behalf of the second respondent wherein, at paragraph No.4, he states that the appeal filed by the petitioner in I.T.A.No.06/IT(A)-PDY/2013-14 has been decided in favour of the petitioner by order of the Commissioner of Income https://hcservices.ecourts.gov.in/hcservices/

Tax (Appeals) dated 06.05.2016 and all additions made in the order of assessment stand deleted.

3. Thus nothing further survives in this Writ Petition and the same is closed recording the aforesaid. No costs. Consequently, connected Miscellaneous Petition is also closed.
