Petitioner seeks modification of condition imposed by learned Principal Sessions Judge, Dharmapuri, under orders in Crl.M.P.No.579 of 2017 dated 05.04.2017, requiring the petitioner to deposit a sum of Rs.40,000/-.
2. Heard learned counsel for petitioner and learned Government Advocate [Crl.side].
3. Petitioner is arrayed as an accused in Crime No.131 of 2017 on the file of respondent for offences u/s.379 IPC r/w Section 21(i) of Mines and Minerals Act. Court below has, while granting anticipatory bail to the petitioner, amidst other conditions, required the petitioner to deposit a sum of Rs.40,000/-. Such condition is onerous. Accordingly, the same shall stand deleted. Time to execute sureties is extended by one https://hcservices.ecourts.gov.in/hcservices/
week from the date of receipt of this order. In all other aspects, the order of Court below shall prevail. The Criminal Original Petition is disposed of with the above direction.
