IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED 14.12.2020
CORAM
THE HONOURABLE Mr.JUSTICE P.N.PRAKASH K.Muthu ... Petitioner Vs.
Srinivasan The Inspector of Police Veeraganur Police Station Gangavalli Taluk Salem District ... Respondent Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish the respondent for his willful, wanton, intentional, malafide, deliberate, disrespect, violation, disobedience and negligence of the order dated 19.02.2015 made in Crl.O.P.No.844 of 2015 by this Hon'ble Court. For Petitioner : Mr.S.Sathyaraj For Respondent : Mrs.P.Kritika Kamal Govt. Advocate (Crl. Side)
O R D E R
It is the case of the petitioner that he gave a complaint dated 08.12.2014 to the respondent police and that, the respondent police did not take any action on his complaint. On these allegations, the petitioner filed Crl.O.P.No.844 of 2015 under Section 482 Cr.P.C., for a direction by this Court to register a F.I.R. on his 1/3
complaint. This Court, by order dated 19.02.2015 in Crl.O.P.No.844 of 2015, issued a template order directing the police to conduct an enquiry and if any cognizable offence is made out, follow the law laid down by the Supreme Court in Lalita Kumari Vs. Government of Uttar Pradesh [(2014) 2 SCC 1]. Alleging non-compliance of the order dated 19.02.2015 in Crl.O.P.No.844 of 2015, the petitioner has filed the present Contempt Petition.
2. This Contempt Petition deserves to be dismissed on the short ground that the petitioner is a busybody, inasmuch as he has not even disclosed his residential address, either in Crl.O.P.No.844 of 2015 nor in the affidavit filed in support of this Contempt Petition. In the alleged complaint dated 08.12.2014, it is the grievance of the petitioner that, one Kaliyamurthy was living with his son Raja in South Kannara Street, Gangavalli Taluk and that Raja died on 14.09.2005, but, Kaliyamurthy did not inform his son's death to the police. For the death of Raja on 14.09.2005, the petitioner had given a complaint on 08.12.2014 and had obtained a template order from this Court, with which, he is blackmailing Kaliyamurthy.
3. Hence, this Contempt Petition is dismissed with costs of Rs.50,000/- payable by the petitioner to "The Chief Minister's Public Relief Fund" (Indian Overseas Bank, Secretariat Branch, Chennai-9, S.B.A/c.No.117201000000070, 2/3
IFS Code-IOBA0001172, CMPRF PAN-AAAGC0038F) within two weeks from the date of receipt of a copy of this order, failing which, the same shall be recovered from him under the Revenue Recovery Act, 1890.
