This Criminal Original Petition has been filed to call for the records and quash the proceedings in E-3, Teynampet Police Station in Crime No.1677 of 2016 for the offence under Sections 420 and 506(1) of I.P.C.
2. The learned counsel for the petitioners submitted that the FIR has been filed only on the basis of money transaction. Subsequently, the parties have entered into a settlement and Memorandum of Understanding has been filed before this Court on 24.07.2017. Besides, the defacto complainant has also given a letter to the Investigating Officer to withdraw the complaint. https://hcservices.ecourts.gov.in/hcservices/
3. The learned Government Advocate(Crl.side) has not disputed the above facts. He further submitted that the defacto complainant himself requested to drop further action against the petitioner. The F.I.R has been filed for the offences under Sections 420 and 506(1) of I.P.C of I.P.C only with regard to money transactions. Now, the entire amount has been paid and defacto complainant himself given a letter for withdrawing his complaint.
4. From the above submissions, this Court is of the view that as the matter is compromised and settled between the parties, there is no pointing of driving the parties to undergo the ordeal of the trial. Hence, the proceedings against the petitioners is quashed.
