Respondents PRAYER: Writ petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Declaration, declaring that the action of the 2nd respondent in issuing the order of promotion to the respondent No.4 to 39 to the post of Sanitary Inspector is illegal, contrary to the Tamil Nadu Municipal Public Health Services Regulation, 1970 and consequently direct the 1st and 2nd respondents to recruit Sanitary Inspector by Direct Recruitment as provided in clause of the Tamil Nadu Municipal Public Health Service Regulation, 1970.

ORDER

Learned counsel for the petitioner submits that the petitioner was appointed to the relevant post after the institution of the writ petition.

2. By this writ petition, the petitioner impugns an order of promotion of respondents 4 to 39 to the post of Sanitary Inspector. The writ petition was instituted in the year 2006. Consequently, the said persons have held the post for a considerable period of time.

3. By taking into account the fact that the petitioner was subsequently appointed and the length of service of the private respondents, W.P.No.9176 of 2006 is closed. Consequently, W.P.M.P.No.10144 of 2006 is also closed.
