ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.12.2025, for the offence punishable under Sections 318(4) of BNS Act, 2023 and 66D of IT Act 2000, in Crime No.79 of 2025, registered on the file of the

respondent, seeks bail.

2. The allegation against the petitioner is that the petitioner is ranked as A2 in this case and he colluded with A1 in this case and involved in floating online trading platform for the purpose of collecting investments and also cheat the innocent victims. Further the petitioner's bank account was linked with the platform for the purpose of transacting the money and through the petitioner's bank account Rs.30 lakhs was also transacted. Hence, the petitioner has been arrested and is in custody from 25.12.2025.

The learned counsel appearing for the petitioner submitted that the petitioner is in incarceration and through his account Rs.30 lakhs have been transacted and is ready to pay 10% of the amount which was transacted through his bank account. He further submitted that there is no previous case reported against the petitioner herein and some of the accused are still freely moving and the respondent has not chosen to take any action against them. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that there are totally two accused in this case and they were identified and both were arrested and the petitioner is one whose bank account has been used as a layer one bank

account for the purpose of transacting Rs.30 lakhs and sofar no money was recovered and the money has been transferred to various bank accounts and now in the shell account and the investigation is going on. Hence, he opposed the grant of bail to the petitioner.

Considering the fact that though it is stated that the petitioner is in incarceration from 25.12.2025, sofar no money is recovered and total money involved in this case is Rs.4.08 crores and though A1 is alleged to have been arrested, this Court is not inclined to grant bail to the petitioner, if the petitioner is granted bail, it will hamper the investigation. Accordingly, this Criminal Original Petition is dismissed.
