Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned suspension order vide R.C.No.641/B1/2023 dated 22.12.2023 passed by the 1st respondent and quash the same as illegal and consequently direct the respondents to reinstate the petitioner into the service along with back wages and pass such orders. 1/6

ORDER
This writ petition has been filed challenging the order dated 22.12.2023 passed by the 1st respondent thereby suspended the petitioner from his service.
2. The petitioner was appointed as Art Teacher in the Government Higher Secondary School, Thummanatty, Connur Taluk, Neelagiri District on consolidated pay. Subsequently, his service was regularized and he was transferred to the Government Higher Secondary School, Kothagiri, Neelagiri District. Once again, he was transferred to Government Higher Secondary School, Thummanatty, Connur Taluk. Thereafter, he was transferred to Government Higher Secondary School, Anchetty, Thenkanikottai Taluk, Krishnagiri District and joined on 19.03.2019. On the complaint lodged by a girl student, it was reported to the concerned police station. In pursuant to the said complaint, FIR was registered in Cr.No.32 of 2023 under section 9(f) r/w. Section 10 of POCSO Act as against one PET 2/6
Teacher Anandakumar. Therefore, all the colleagues and Headmaster of the 2nd respondent school developed disgruntle against the petitioner. Therefore, without any reason, the petitioner was suspended from his service on 22.12.2023.
3. On perusal of the order of suspension revealed that several allegations are made as against the petitioner and yet to serve with charge memo.
4. Therefore, this Court find no infirmity or illegality in the order passed by the first respondent dated 22.12.2023. However, this Court direct the disciplinary authorities to serve charge memo to the petitioner and complete the disciplinary proceedings within a period of six months from the date of receipt of copy of this order.
5. With the above direction, this writ petition is dismissed. 3/6
