ORDER

This Writ Petition has been filed for direction directing the first respondent to dispose the representation submitted by the petitioner dated 10.10.2023 seeking departmental proceedings as against the respondents 2 and 3 herein.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 to 3 and perused the materials available on record.

3. The case of the petitioner is that the fourth respondent approached the petitioner and borrowed loan to the tune of Rs.1,20,000/- by executing a Mortgage Deed. However, the fourth respondent failed to settle the loan amount, though the petitioner made several request. Therefore, the petitioner lodged a complaint before the third respondent and he was issued CSR No.115 of 2018. The fourth respondent appearing for enquiry and he had given undertaking to settle the amount. The petitioner also filed a direction petition to register the FIR in CSR No.115 of 2018. However, the petition was closed, since the complaint lodged by the petitioner was enquired and closed.

4. It is seen that it is a money transaction between the petitioner

and the fourth respondent. As such, the third respondent rightly closed the CSR No.115 of 2018. Now, the petitioner sought for disciplinary action as against the third and fourth respondents. It cannot be considered and the writ petition itself is devoid of merits and it is liable to be dismissed.
