Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to return the registered partition deed dated 14.06.2016 document No.482/16 without insetting to pay Rs.9,00,000/- as deficit registration fees and deficit stamp duty to the petitioner on the basis of the petitioner representation dated 28.06.2016.

This writ petition has been filed for the issue of writ of mandamus directing the respondents to return the registered partition deed dated 14.06.2016 without insisting for the payment of the deficit stamp duty and registration charges.

2.When the matter came up for hearing on 19.02.2025, this Court directed the learned Special Government Pleader to take instructions as to why the document was not returned back to the petitioner. 3.When the matter was taken up for hearing today, the learned Special Government Pleader submitted that the value that was shown in the partition deed did not reflect the correct market value and hence, the document was referred to the District Registrar for fixation of the correct guideline value and accordingly, the valuation was fixed. Aggrieved by the same, the petitioner has also filed an appeal and it is pending. 4.In the light of the above development, the relief as sought for by petitioner in this writ petition cannot be granted by this Court and it is left open to the petitioner to workout the remedy in the appeal and proceed further in accordance with law.

5.Accordingly, this Writ Petition is disposed of in the above terms. No costs.
