ORDER

This writ petition has been filed to direct the 3rd respondent Police to give police protection to the petitioner's life and limb at his agricultural lands comprised in Survey No.59/3B2 and Survey No.58/2B situated in M.Palapatty Village, Salem Taluk, Salem District.

2.The petitioner owns agricultural lands admeasuring 1.23 acres and 321⁄2 cents in Survey Nos.59/3B2 and 58/2B respectively, situated at M.Palapatty, Salem Taluk, Salem District, both registered at the Joint Sub-Registrar's Office-1, Salem

(East). The 4th and 5th respondents herein are attempting to trespass into the petitioner's lands and disturb the peaceful possession and enjoyment of the said property, for which purpose, the petitioner had lodged a complaint against them before the 3rd respondent Police. Since the complaint was not acted upon, the petitioner had approached the III Additional District Munsif, Salem, by way of filing a Civil Suit in O.S.No.538 of 2021 seeking permanent injunction. By an order dated 25.04.2025, the Civil Court had passed an order of ad-interim injunction restraining the private respondents herein from interfering with the possession of the petitioner.

3.The learned counsel for the petitioner would submit that inspite of the order of the Civil Court, the 4th and 5th respondents are continuing to interfere with the peaceful possession of the petitioner's property. Thus, the petitioner has approached this Court seeking police protection. 4.It is not in dispute that the Civil Court had granted an order of interim injunction restraining the private respondents herein from disturbing the petitioner's peaceful possession of the subject property. However, when the Civil

Court has taken cognizance of the matter, which is pending for final adjudication, this Court is of the view that the petitioner ought to have approached the Civil Court once again for seeking police protection or any other appropriate relief. Therefore, the prayer sought for in the present writ petition seeking police protection cannot be granted.
