Crl.M.P.No.11196 of 2016 in Crl.A.SR.45090 of 2016 --- S.BASKARAN, J.
This petition is filed praying to condone the delay of 36 days in filing the above Appeal, against the judgment passed in Spl.C.C.No.17/2014, dated 26.04.2016, on the file of the Special Court for trial of cases under Prevention of Corruption Act, Salem.
2. According to the learned Additional Public Prosecutor, appearing for the petitioner/appellant/State, the delay occurred only due to administrative reasons, that is, in getting sanction from the Department concerned and thereafter, filing appeal before this court.
3. The above said contention has been opposed by the learned counsel appearing for the respondent/accused, stating that even after legal opinion obtained in this matter, there is delay of 33 days in making request before the authority concerned and getting permission with regard to filing of appeal, and the said delay has not been properly explained by the prosecution.
1. Taking into consideration the reasons stated in the affidavit S.BASKARAN, J.
filed in support of this petition, and on going through the submissions of the learned Additional Public Prosecutor, it is seen that the delay is only due to administrative reasons. Hence, I am inclined to condone the delay of 36 days in filing the above appeal. Accordingly, the delay is condoned. This Crl.M.P., is ordered.
