ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.01.2026, for the alleged offence punishable under Sections 123 of Bns r/w. Section 24(1) of COTPA Act in Crime No.3 of 2026 on the file of the

respondent police, seeks bail.

2.The allegation against the petitioner is that the petitioner is ranked as A1 in this case, and he joined hands with other accused involved in transportation of 330 kgs of banned tobacco products, and while it was being transported it was intercepted and the petitioner left the contraband and escaped from there. However, after registration of the FIR, the police have identified the petitioner as the owner of the vehicle and arrested him.

3. Learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated since the petitioner was not present at the time of seizure and is ready to cooperate with the investigation. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the vehicle and contraband were seized, and investigation revealed the vehicle is registered in the petitioner's name. He further submitted that the petitioner was arrested, admitted guilt, and has one previous case of similar in nature. Hence, he opposed for grant of bail to the petitioner.

5. Considering the fact that the petitioner has been arrested only recently, and the petitioner is also having one previous case of similar in nature, this court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
