Yogarajan v. D.Sivakumar
Crl. O.P. No.3137 of 2023 and Crl.A.SR No.4975 of 2023 This petition is filed under Section 378(4) Cr.P.C, to grant special leave to file an appeal against the judgment dated 14.12.2022 passed in STC No.73/2022 by the Judicial Magistrate, Fast Track Court at Magisterial Level, Coonoor.
2. Heard Mr. A. Sri Ram, learned counsel for the petitioner and Mr. S. Gajalakshmi, learned counsel for the respondent.
3. Mr. A. Sri Ram, learned counsel for the petitioner contended that the trial court acquitted the accused mainly on the ground that the present petitioner/complainant lent a sum of Rs.4 lakhs to the resplendent/accused, as a financier, and that he did not also produce the Books accounts as per the Tamil Nadu Money Lenders Act.
4. In such circumstances, there are arguable points in the present case and therefore, leave is granted as prayed for. 1/2
