ORDER

The petitioners apprehend arrest at the hands of the respondent police for the alleged offence punishable under Section 303(2) of BNS Act and Section 21(1) of Mines and Minerals (Development & Regulation) Act, 1987 in Crime No. 11 of 2026, seeks anticipatory bail.

2. The case of the prosecution is that based on secret information, the respondent police went to the scene of occurrence and found that the petitioners had illegally quarried three units of morambu sand from the lake. On seeing the police officals, the petitioners dropped the vehicle and ran away. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that the petitioners have not committed any such offence as alleged by the prosecution and they have been falsely implicated in this case. Hence, he prayed to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioners have no previous cases pending against them. Hence, he

opposed to grant anticipatory bail to the petitioners.

5. Considering the fact that the petitioners are directly involved in the illegal quarrying and transportation of sand from the lake, this Court is not inclined to grant anticipatory bail to the petitioners.
