PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to disburse the terminal benefits, G.P.F, S.G.P.F, Group Insurance, gratuity, family pension etc. due to the family of the petitioner. O R D E R

This Writ Petition has been filed for direction directing the respondents to disburse the terminal benefits and other benefits of her deceased husband.

2. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents and perused the materials available on record.

3. Pending writ petition, the petitioner/wife of the deceased employee also died. The legal heirs were substituted as petitioners. According to the petitioners, their father died on 07.08.1996 while he was in service as Supervisor in the Health Department. However, the petitioner failed to submit their details when their father was placed in 2/4

service while he was alive and they also failed to submit any particulars about the death of their father. Therefore the respondents, by its communication dated 06.01.1997, directed the deceased petitioner/mother of the petitioners to produce details. However, without producing the same, the deceased petitioner caused legal notice on 07.03.2001.

4. In view of the above, this Court finds no merits in this writ petition for issuance of direction and the Writ Petition is devoid of merits. Accordingly, this Writ Petition stands dismissed. However, the petitioners are at liberty to furnish all the particulars as required by the respondents and make further representation. On receipt of such representation, the respondents are directed to consider the same in accordance with law. Consequently, connected miscellaneous petition is closed. No costs.
