Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, calling for the concerned records from the first respondent, quash the order of the first respondent bearing G.O (D) No.1029, Labour and Employment (A1) Department dated 10.08.2004 as illegal, arbitrary, contrary to Section 10

(1) of the Industrial Disputes Act and without jurisdiction and consequently direct the first respondent to refer the industrial dispute raised by the petitioner Unions vide its strike notice received by the Conciliation Officer on 07.09.1999 and 03.12.1999 for adjudication.

O R D E R

The learned counsel appearing on behalf of the writ petitioners as well as the learned Additional Government Pleader appearing on behalf of the first respondent and the learned counsel appearing on behalf of the second respondent have made a submission that on account of efflux of time, the issues deserve no merit adjudication. This apart, almost 20 years lapsed on account of the fact that the litigations are pending before the Court.

2. Under these circumstances, this Court is not inclined to adjudicate the issues raised in the present writ petition. However, the respective parties are at liberty to adjudicate the same if any other grievance exists as of now in the manner known to law.

3. Accordingly, the writ petition stands closed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is also closed.
