PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records of the 1st respondent relating to his Rc.No.Estt.V (1)/188/38371/2004 [C.P.O.No.1452/2004] dated 14.07.2004 and that of the 2nd respondent in Rc.No.Estt.V (1)/ 188/38371/2004 [C.P.O.No.145/2004] dated 04.08.2004, quash the same and issue consequential directions to respondents 1 and 2 to select the petitioner herein on the basis of his performance in the written test conducted on 18.06.2004 and to redraw the 'C' List and include his name in the 'C' List of Head Constables (Armed Reserve), fit for promotion as Sub Inspector of Police (Armed Reserve) for the year 2003 in the appropriate place therein and promote him as such with retrospective effect from the date of promotion of his immediate junior with consequential benefits.

The petitioner, being aggrieved on his non-selection for the post of Head Constable pursuant to the written test conducted on 18.06.2004, has challenged the 'C' list of

candidates selected for promotion as Sub-Inspector for the year 2003. The petitioner was aged about 41 years when the Writ Petition was filed and he has now attained the age of superannuation. As such, no fruitful orders can be passed in the present Writ Petition.
