O R D E R

The petitioner, who apprehends arrest for the alleged offence under Sections 303(2) of BNS Act r/w Section 21(1) Mines and Minerals 1/4

(Development and Regulation) Act, 1957 in Cr.No.416 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. Earlier, this Court vide order dated 03.11.2025 in Crl.O.P.No.27550 of 2025 dismissed the petitioner's anticipatory bail petition for the following reasons:

" 5. Considering the fact that the petitioner is not only damaged the river bed but also caused ecology; if the anticipatory bail grants to the petitioner, he would damage the ecology and water bodies, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed ".

3. Now, the present petition has been filed without any change in circumstances after the dismissal of the petitioner's earlier bail petition. This clearly shows that the petitioner has abused the process of law. Hence, I am not inclined to reconsider the earlier order.

4. Accordingly, this Criminal Original Petition is dismissed. 03.02.2026 Vv 2/4
