The petitioner/fourth accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 6 read with 20(1) COTPA Act 2003 & 328 of IPC in Crime No.194 of 2023, seeks anticipatory bail.

2. The earlier anticipatory bail application had been dismissed on 13.10.2023 in Crl.O.P.No. 23735 of 2023. It is stated that the vehicle belonging to the petitioner bearing Reg.No. Tamil Nadu 38BE 2224, TOYOTA FORTUNER coming from Bangalore to Krishnagiri was checked by the respondent and it was found that banned Tobacco product worth Rs.1,99,920/- were available in the vehicle. The petitioner is the fourth accused. The first accused had been taken into custody and had been granted bail by a learned Single Judge of this Court in Crl.O.P.No. 18875 of 2023 dated 22.08.2023. However, it is seen that A2 and A3 are absconding. They are the driver and the other occupant of the Car. The petitioner had lent out his Car for that particular purpose. He must also be aware about the presence of A2 and A3, who were the driver and occupant.

3. It is stated on behalf of the respondent that the person who had actually supply the contraband will have to be found out and in view of that particular fact, further investigation is required, particularly since the contraband was seized from the vehicle belonging to the petitioner herein.

4. The earlier application seeking anticipatory bail was dismissed on 14.12.2023 in Crl.O.P.No. 27387 of 2023. There is no change in circumstances. A-2 and A-3 are still absconding.
