Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records of the second respondent herein in Na.Ka.No.56357/2017/DPC.2.2 dated 28.06.2023 and quash the same as arbitrary and against the principles of natural justice and consequently direct the respondents to promote the petitioner to the post of Assistant Director for the year 2023 to 2024 on the date when his immediate junior was promoted.

ORDER

This writ petition has been filed calling for the records of the second respondent herein in Na.Ka.No.56357/2017/DPC.2.2, dated 28.06.2023 and quash the same as arbitrary and against the principles of natural justice and consequently, direct the respondents to promote the petitioner to the post of Assistant Director for the year 2023 to 2024 on the date when his immediate junior was promoted.

2. Heard the learned counsel on either side and perused the materials available on record.

3. A perusal of the impugned order dated 28.06.2023 revealed that there is an appellate remedy available for the petitioner as against the said impugned order.

4. Therefore, this writ petition is dismissed with liberty to the petitioner to file an appeal as against the impugned order, in the manner known to law. Consequently, connected Miscellaneous petitions are closed. There shall be no order as to costs.
