Respondent PRAYER: The Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified mandamus calling for the records of the respondent issued in Na.Ka.No.7337/A4/A2/2008 dated 13.10.2008 and quash the same and issue a consequential direction to the respondent to allow the petitioner to continue as a Secondary Grade Teacher in Government Higher Secondary School, Namakkal North, Namakkal District.

This writ petition is filed challenging the order of the respondent transferring the petitioner on the ground that she was found surplus.

2. According to the petitioner the respondent has not considered the students strength as well as the students teacher ratio. This Court considering the primafacie case has granted an order of interim stay of transfer and with the strength of that interim order, she continued in the same school.

3. When the matter is taken up for final hearing, the learned counsel for petitioner would submit that the respondent can revisit the order considering the school strength as well as https://hcservices.ecourts.gov.in/hcservices/

the students teacher ratio and thereafter pass appropriate orders. I consider it as a reasonable prayer and accordingly grant the same.

4. In fine, the writ petition is disposed of with a direction to the respondent to consider the present students strength of the school and also students teacher ratio and pass appropriate orders, within a period of 12 weeks from the date of receipt of a copy of this order. No costs. Connected miscellaneous petition is closed.
